Terms of service
Last updated
These terms cover using Endless Social Media Manager (“ESMM”), which [operator's legal name] runs (“we”, “us”). By signing in to ESMM, or by sending files through one of its upload links, you agree to them. If you use ESMM for a business, you agree to them for that business too.
Using ESMM
ESMM lets a business plan, write, approve and publish posts to the accounts it connects, keep a library of photos and videos, and see how its accounts are doing. You may use it for the businesses you've been invited to. We may change, add or remove features as ESMM develops.
Accounts and roles
- ESMM is by invitation: a business's owners invite the people who work on it.
- Each person has their own account. Don't share it or its password, and tell us at [privacy email address] if you think someone else has used it. We recommend turning on an authenticator app.
- Each person has a role in each business: Owner (everything, including connected accounts, people and the activity log), Manager (approves and publishes posts, runs settings and upload links), Creator (writes posts, uses AI captions and posts from their phone), Contributor (adds photos and videos to the library) or Viewer (sees plans and posts, changes nothing).
- Owners decide who has which role, and each business is responsible for what its people do in ESMM.
Your content
Your business keeps all its rights to its posts, captions, photos and videos. It lets us store, copy, resize and send them only as needed to run ESMM for it: to the platforms it publishes to, and to Anthropic for AI suggestions, as the privacy policy explains.
You confirm that you have the right to upload and publish what you add to ESMM, including permission from the people who appear in it. Upload links ask each sender to agree to the consent text the business sets, and the business is responsible for that text and for using what it receives as agreed.
AI suggestions
Tags, captions and draft posts from Claude are suggestions, and they can be wrong. Check them before you publish.
Acceptable use
Don't use ESMM to:
- break the law, or post anything illegal, deceptive, hateful, harassing or sexually explicit;
- post content you don't have the rights to, or that shows people who haven't agreed to it;
- send spam or misleading content, or pretend to be someone else;
- connect accounts you aren't allowed to manage;
- get into data or accounts that aren't yours, or test, overload or get around ESMM's security or limits;
- break the rules of a platform you post to.
Each platform’s terms apply
When ESMM posts to a platform or reads from it, that platform's terms apply to you as well:
- Facebook and Instagram: Meta Terms of Service and Instagram Terms of Use
- Google Business Profile: Google Terms of Service
- TikTok: TikTok Terms of Service
- WordPress: your site host's terms, and for a site on WordPress.com, the WordPress.com Terms of Service
Platforms can change their rules or limit what apps may do. When they do, ESMM may have to stop doing something it did before.
Suspending or ending access
You can stop using ESMM at any time. We may suspend or end access for anyone who breaks these terms, or whose use puts ESMM, other businesses or the platforms at risk. When a business stops using ESMM, it can have its data deleted as Data deletion explains.
No warranty
ESMM is provided “as is” and “as available”. We work to keep it running and your posts on time, but we don't promise that it will always be available or free of errors, that every post will go out on time, or that the stats the platforms report are complete or correct. As far as the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
As far as the law allows, [operator's legal name] isn't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of ESMM, even if we were told they might happen. Our total liability for all claims about ESMM is limited to the greater of what you paid us for ESMM in the 12 months before the claim and 100 US dollars.
Changes to these terms
We may update these terms. When we do, we'll change the date at the top, and if you keep using ESMM after that, the new terms apply.
